1. Acceptance of These Terms

You accept these Terms of Service when you browse this website, submit a quote request, approve a design proof, or place an order. These terms apply to every order. If you do not agree with these terms, do not use the site and do not place an order. We reserve the right to update these terms, and the version posted on this page governs your order.

2. Who We Are

We manufacture custom patches in New York and ship them nationwide. In these terms, “Custom Patches New York,” “CPNY,” “we,” “us,” and “our” refer to the business. “You” and “your” refer to the customer who uses the site or places an order. Our studio operates at 90 Broad St, 2nd Floor, New York, NY 10004, and our phone number is (917) 735-9139.

3. Quotes and Pricing

We provide free, no-obligation quotes. We return most quotes within 1 hour, and within a 2 hour maximum during business hours. A quote reflects the patch type, size, quantity, backing, and finish you specify. Quoted prices remain valid for the period stated on your quote. We price custom work per order, because patch cost depends on type, size, stitch or print complexity, quantity, and backing. We charge no minimum order fee. You order one piece or thousands of pieces at the same standard of service.

4. Orders and Order Acceptance

You place an order by approving a quote and authorizing payment. An order becomes binding when we confirm it and you approve the design proof. We may decline or cancel any order, including an order that requests unlawful content, infringing artwork, counterfeit insignia, or a design we cannot produce to our quality standard. If we decline an order after you pay, we refund the amount you paid for that order.

5. Design Proofs and Approval

We provide free design proofs with unlimited revisions. We send a digital proof before any production begins. You review the proof for spelling, colors, dimensions, artwork placement, and backing. Production starts only after you approve the proof in writing. You hold responsibility for the accuracy of the proof you approve. We produce your patches to match the approved proof, and we do not accept claims for errors that appear in a proof you already approved.

6. Production and Turnaround

We produce standard orders within 7 to 10 business days after you approve the design proof. Production time excludes shipping transit time. Large quantities, complex artwork, and specialty materials extend the timeline, and we state the revised estimate before production starts. Turnaround figures are production estimates, not guaranteed delivery dates.

7. Payment

We require payment before production begins. We accept the payment methods listed at checkout or on your invoice. Custom patches are produced to your specification, so we collect payment in full before we start production. The production clock starts after we receive cleared payment and your written proof approval.

8. Shipping and Delivery

We ship every order with free, tracked shipping across New York and the United States. We ship through carriers such as FedEx, UPS, and USPS, and we send tracking details when your order leaves our facility. Title and risk of loss pass to you when the carrier accepts the package. Delivery dates depend on the carrier and fall outside our control after handoff. We are not liable for carrier delays, and we help you trace a delayed or lost shipment. We serve all five New York City boroughs, the tri-state metro area, and customers nationwide.

9. Custom Products, Returns, and Refunds

We manufacture every patch to your specification, so custom patches are non-returnable once produced. This policy does not limit your rights when the error is ours. We remake or refund any order that arrives defective or that deviates from your approved proof. You report a defect or a proof deviation within the return window stated on our Shipping and Returns page and include clear photos. We do not refund an order for a design error contained in a proof you approved, for a color expectation the approved proof did not specify, or for a change of mind after production begins.

10. Cancellations and Changes

You cancel or change an order at no cost before you approve the design proof. After proof approval and the start of production, we cannot cancel or change the order, because production of custom goods has already begun. 11. Customer Artwork and Intellectual Property

You keep ownership of the artwork, logos, and designs you submit. You grant us a limited license to use your artwork to proof, produce, and fulfill your order. You confirm that you own your artwork or hold the rights to use it, and that your design does not infringe a third party’s trademark, copyright, or other rights. We may decline artwork that appears unlawful, infringing, or counterfeit. The content on this website, including text, graphics, and page layout, belongs to us. 12. Institutional Insignia and Non-Affiliation

We produce patches for individual officers, units, departments, and supporters of law enforcement and fire service organizations. Custom Patches New York is not officially affiliated with the New York Police Department or the New York City Fire Department, and we do not represent any agency. You confirm that you hold the authority to reproduce any department insignia, unit logo, or official seal you submit. We produce institutional insignia only when you provide that authorization.

13. Indemnification

You agree to indemnify us against claims, damages, and costs that arise from the artwork you submit, including any claim of trademark or copyright infringement. This obligation covers the legal fees we incur to respond to such a claim.

14. Warranties and Disclaimers

We warrant that your patches match the approved proof and meet our workmanship standard. We provide this website and its content on an “as is” basis. To the extent the law of the State of New York permits, we disclaim implied warranties beyond the workmanship warranty stated here.

15. Limitation of Liability

To the extent New York law permits, the total liability of Custom Patches New York for any order is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential damages, including lost profits, that arise from an order or from your use of this website.

16. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the State of New York, without regard to conflict-of-law rules. You and Custom Patches New York agree that the state and federal courts located in New York County, New York, hold jurisdiction over any dispute that arises from these terms or from an order.

17. Privacy

We handle your personal information according to our Privacy Policy. The Privacy Policy explains what we collect, how we use it, and how we protect it. Your use of this site means you accept the practices described there.

18. Changes to These Terms

We update these Terms of Service when our practices or legal obligations change. We post the current version on this page with a new effective date. Your continued use of the site, or your placement of a new order after an update, means you accept the revised terms.

19. Severability and Entire Agreement

If a court finds any clause of these terms unenforceable, the remaining clauses stay in full effect. These Terms of Service, together with the quote, invoice, and approved proof for your order, form the entire agreement between you and us for that order.
